2. Acceptance of Terms

By creating an account or using the Dear Tomorrow application ("the App"), available at deartomorrow.me, you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully before using the App.

If you do not agree to these Terms, you must not use the App.


3. Eligibility

3.1 Minimum Age

You must be at least 13 years old to use Dear Tomorrow. By using the App, you confirm that you meet this requirement.

3.2 Users Aged 13–17

If you are between 13 and 17 years old, you confirm that you have obtained parental or guardian consent before creating an account. By ticking the consent checkbox during sign-up, you are confirming this consent.

Billy's App Studio reserves the right to terminate any account that we reasonably believe belongs to a user under 13.


4. Account Registration

  • You must provide accurate, complete, and current information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately at billysappstudio@gmail.com if you suspect any unauthorised access to your account.
  • You may not create accounts on behalf of other people or share your account with others.
  • We reserve the right to suspend or terminate your account at our discretion, including for any violation of these Terms.

5. The Service

5.1 What Dear Tomorrow Does

Dear Tomorrow allows you to write letters to yourself or others, scheduled for delivery on a future date of your choosing. Letters are delivered via email to the recipient address you provide.

5.2 Service Availability

We will make reasonable efforts to keep Dear Tomorrow available and operational. However, we do not guarantee:

  • Uninterrupted availability — the App may be temporarily unavailable due to maintenance, upgrades, or factors outside our control.
  • Perpetual operation — see Section 10 (Service Discontinuation) for what happens if the service closes.

5.3 Delivery of Letters

  • Letters are delivered on or around the scheduled delivery date. We will make reasonable efforts to deliver letters on time, but delays may occur due to technical issues or third-party service interruptions.
  • Delivery depends on the recipient email address being valid and accessible at the time of delivery. We are not responsible for letters that cannot be delivered to an invalid, full, or inaccessible inbox.
  • We are not responsible for letters delivered to incorrect addresses due to errors made by you when entering recipient details.

6. Payments

6.1 Pricing

Each letter costs $2.00 USD per recipient. Pricing is displayed clearly before you complete your purchase. We reserve the right to change pricing at any time; any price change will not affect letters already paid for.

6.2 Payment Processing

All payments are processed securely by Polar. By making a payment, you also agree to Polar's Terms of Service. We do not store your full payment card details.

6.3 Refund Policy

  • Before sending: If your letter has not yet been delivered, you may cancel it from your dashboard to receive a full refund.
  • After delivery: Once a letter has been delivered to the recipient, no refund will be issued.
  • Failed delivery: If a letter fails to deliver due to a fault on our part (e.g. a technical error on our platform), we will issue a full refund or resend the letter, at your request.

7. Acceptable Use

You agree not to use Dear Tomorrow to:

  • Write or send content that is unlawful, abusive, harassing, threatening, defamatory, obscene, hateful, or discriminatory.
  • Send spam or unsolicited bulk messages to multiple recipients.
  • Impersonate any person or entity, or falsely represent your affiliation with a person or entity.
  • Attempt to gain unauthorised access to any part of the App, its systems, or other users' accounts.
  • Use the App in any way that could damage, disable, or impair the service or its infrastructure.
  • Use automated tools, bots, or scripts to access or interact with the App.
  • Violate any applicable local, national, or international laws or regulations.

We reserve the right to remove any content or suspend any account that we reasonably believe violates these restrictions, without prior notice.


8. Your Content

8.1 Ownership

You retain ownership of any letter content you write using the App. By submitting content, you grant Billy's App Studio a limited, non-exclusive licence to store and transmit that content solely for the purpose of delivering your letter and operating the service.

8.2 Content Responsibility

You are solely responsible for the content of your letters. We do not routinely review or moderate letter content, but we reserve the right to remove content that violates these Terms or applicable laws.

8.3 Sensitive Content

Given the emotional nature of the App, if we become aware of content that suggests immediate risk of harm to you or others, we may take appropriate steps, which could include contacting relevant authorities.


9. Intellectual Property

All content on the Dear Tomorrow platform that is not user-generated — including the app design, branding, logo, copy, and code — is owned by Billy's App Studio and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any of it without our express written permission.


10. Service Discontinuation

We hope to operate Dear Tomorrow for many years. However, if we need to shut down the service permanently, we will:

  • Provide at least 30 days' notice to all registered users via email before the service closes.
  • Deliver all pending scheduled letters immediately before the service closes, where technically possible.
  • Provide a reasonable opportunity for you to download or retrieve your letter content before closure.

We will not be liable for any damages resulting from service discontinuation, provided we have given reasonable notice and made best efforts to deliver scheduled letters.


11. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, either express or implied. To the fullest extent permitted by law, Billy's App Studio disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Guarantees that the App will be error-free, uninterrupted, or secure.
  • Guarantees that any defects will be corrected.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Billy's App Studio and its operators will not be liable for any:

  • Indirect, incidental, special, or consequential damages arising from your use of the App.
  • Loss of data, including lost letters or undelivered messages, beyond our reasonable control.
  • Emotional distress resulting from the content of letters received or letters that fail to deliver.

Our total liability to you for any claim arising from your use of the App shall not exceed the total amount you have paid us in the 12 months prior to the claim.


13. Indemnification

You agree to indemnify and hold harmless Billy's App Studio, its operators and agents, from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the App.
  • Your violation of these Terms.
  • Any content you submit through the App.

14. Third-Party Services

The App relies on third-party services including Supabase, Polar, Resend, and PostHog. We are not responsible for any failures, outages, or policy changes by these providers that affect the delivery of our service. Use of these services is also subject to their respective terms and privacy policies.


15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer located in the European Union, you may also have rights under the laws of your country of residence, which these Terms do not override.


16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page.
  • Notify users via email or a prominent notice within the App.

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
